"About the provision of a voluntary charitable donation and privacy policy"

Preamble

This offer, addressed to an unspecified circle of individuals - individuals and legal entities (hereinafter - Donors) - visitors to the website on the Internet: mercy-centre.com (hereinafter - the Website), and is an official and public offer of the charitable organization "Fund to help patients with cancer" organization code 44844827, address: Ukraine, 79040, city of Lviv, str. V.Kurmanovicha 1, hereinafter referred to as the "Fund", in the person of the head of the Fund - Oleksandr Oleksandrovych Semashko, acting on the basis of the Statute, (together - the Parties, and each separately - a Party) to enter into a voluntary charitable donation agreement (hereinafter - the Agreement), subject and the essential conditions of which are indicated below:

  1. 1. Terms and definitions:

    Acceptance - full and unconditional acceptance of a public offer by taking actions to make a money transfer using the payment forms and means posted on the website, as well as by transferring funds to the Fund's current account through bank institutions.

    The moment of acceptance is the date of transfer of funds to the Fund's current account.

    Payment is a voluntary charitable donation

    Voluntary charitable donation - making a monetary transfer by the Donor to achieve the goals, objectives, directions and types of statutory activities of the Fund in accordance with this Agreement and the Law of Ukraine "On Charitable Activities and Charitable Organizations".

  2. 2. Subject of the contract.

    2.1. The subject of this contract is the free transfer by the Donor to the Fund of funds for the achievement of the Foundation's goals, objectives, directions and types of statutory activity.

    2.2. Acceptance of this Agreement means that the Donor agrees with all its provisions, as well as that he is fully aware of the subject of this Agreement and the purpose of collecting voluntary charitable donations.

    2.3. The Agreement is concluded by unconditionally and fully joining the Donor to this Agreement and accepting all the terms of this Agreement.

    2.4. The Donor and the Fund, based on Art. 207, Part 2 of Art. 639, Art. Art. 641, 642, 729 of the Civil Code of Ukraine, Art. 7 of the Law of Ukraine "On Charitable Activities and Charitable Organizations", agreed that this Agreement is considered to be concluded in writing without signing a written copy by the Parties from the moment the Donor takes the actions provided for in the Agreement, which testify to the agreement to comply with the terms of the Agreement.

    2.5. The Agreement is posted on the website mercy-centre.com in a freely accessible manner and in a way that ensures familiarization with the content of this Agreement for every person who applies to the Fund. The Donor cannot offer his own terms of the Agreement or change these terms at his own discretion.

  3. 3. Rights and obligations of the parties.

    3.1. The Foundation has the right to receive voluntary charitable donations and use them to achieve the goals, objectives, directions and types of statutory activities of the Foundation in accordance with this Agreement and the Law of Ukraine "On Charitable Activities and Charitable Organizations".

    3.2. At the request of the Donor, the Foundation is obliged to provide a report on the voluntary charitable donation received and its use.

    3.3. The benefactor has the right to transfer a voluntary charitable donation to the Fund's account in the manner specified in the Agreement.

    3.4. Ask the Foundation for a report on the use of a voluntary charitable donation.

  4. 4. Place of collection of funds: The collection of voluntary charitable donations is held at the legal address of the Foundation: Ukraine, 79040 Lviv city, 1 V. Kurmanovicha street.

  5. 5. Term of collection of funds.

    The collection of voluntary charitable donations continues until the moment of liquidation of the Fund, unless another term is determined by the Fund.

  6. 6. Reporting of the Fund.

    6.1. Access to the Fund's reports is provided by the Fund by placing them on the website mercy-centre.com in the "Reports" section.

    6.2. Other information may be provided by the Fund in the manner and within the time limits stipulated by the legislation of Ukraine.

  7. 7. Expenses related to the fulfillment of the terms of this Agreement.

    7.1. All expenses for the payment of sums related to the transfer of charitable charitable donations are borne exclusively by the Donor.

  8. 8. Confidentiality and protection of personal data.

    8.1. By providing his personal data to the Fund on the Fund's Website when registering or making a voluntary donation or fulfilling other terms of this Agreement, the Donor gives the Fund his voluntary consent to processing, use (including placing them in the "Reports" section on the Fund's Website ) of their personal data, as well as taking other actions provided for by the Law of Ukraine "On the Protection of Personal Data", without limiting the validity period of such consent.

    8.2. The Foundation undertakes not to disclose the information received from the Donor.

    It is not considered a violation for the Foundation to provide information to third parties acting on the basis of this Agreement with the Donor, including for the fulfillment of obligations to the Donor (posting them in the "Reports" section on the Foundation's website), as well as in cases where the disclosure of such information is established by the requirements of the current legislation of Ukraine.

    8.3. The donor is responsible for keeping his personal data up-to-date.

    8.4 The Foundation is not responsible for poor performance or non-performance of its obligations due to the irrelevance of information about the Donor or its inconsistency.

  9. 9. Other conditions.

    9.1. The donor independently determines the size of the voluntary charitable donation. Donation is voluntary and non-refundable.

    9.2. The donor is responsible for the accuracy of the information provided when transferring the donation.

    9.3. In order to comply with the Law of Ukraine "On the Protection of Personal Data" and to fulfill the terms of the Agreement, the Donor consents to the collection and processing of personal data.

    9.4. The provisions of Ukrainian legislation apply to the relationship between the Donor and the Fund
